TERMS AND CONDITIONS OF USE

Entity: Pivotus Academy presented online as Pivotus Africa (“The Provider”)

These Terms and Conditions govern the relationship between Pivotus Academy and any individual or entity (“User” or “Client”) accessing our platform and services. By using the Website, you agree to be bound by these terms in their entirety.


  1. Nature of Services & Non-Accreditation Disclosure
    1.1 Skills Training Only: The Provider provides online skills-based training, tutorials, and educational content (“Courses”).
    1.2 No Framework Accreditation: > IMPORTANT NOTICE: Any certificate or letter of completion issued by The Provider is a recognition of skills acquired through the specific course curriculum only. At no point do these certificates of completion provide or imply accreditation by any national or international quality framework, including but not limited to the Namibia Qualifications Authority (NQA) or any other African educational regulatory body.
    1.3 Professional Use: The User is responsible for determining if the course content meets their internal corporate or personal development requirements or industry-specific standards.
    1.4 Outcome Disclaimer: The Provider does not guarantee specific employment, promotions, or financial gains.
    1.5 User Responsibility: The User acknowledges that these courses are for personal or professional development and may not be used to claim formal academic credits or regulated professional standing.
    1.6 Academic Credit: Courses may not be used to claim formal academic credits or regulated professional standing.
  2. Eligibility and Account Security
    2.1 Age Requirement: Users must be at least 18 years of age or have express permission from a parent or legal guardian.
    2.2 Credentials: Users are strictly prohibited from sharing login credentials. The User is 100% and solely responsible and liable for maintaining the confidentiality of their account and all the activities occurring on/under their account.
  3. Fees and Payment
    3.1. Pricing: Prices are displayed on the course pages and are subject to change at our sole discretion. All prices are subject to change without notice at the Provider’s sole discretion.
    3.2. Payment Terms: All payments must be made through the approved portals on the Website. For corporate clients, payment is due within 10 (ten) calendar days of the invoice date.
  4. Refund and Returns Policy
    4.1. The 7-Day Window: Refund requests will only be considered within 7 (seven) working days from the transaction date.
    4.2. Administrative Fee: A non-refundable 5% administrative fee will be deducted from any approved refund to cover transaction and processing costs.
    4.3. Fair Usage & Invalidation: Notwithstanding Clause 4.1, a refund request is automatically invalidated if the User has accessed or completed more than 10% of the course content or has already attempted a final assessment/certificate.
    4.4. No Refund: If the User enrols to any course offered at a discounted/promotional price, the User shall forfeit the right to request a refund for any reason.
  5. Intellectual Property (IP) Rights
    5.1. Exclusive Ownership: All content—including text, graphics, videos, and proprietary code—is the exclusive property of The Provider.
    5.2. Limited/Restrictive License: Enrolment grants a limited, non-transferable, revocable license for personal, non-commercial use only.
    5.3. Prohibited Conduct: Users may not copy, reproduce, distribute, reverse engineer, or create derivative works from our materials. Unauthorised sharing may lead to immediate termination and legal litigation.
    • Legal Consequences: Unauthorised sharing or “group buying” will result in immediate account termination and aggressive legal litigation.
  6. Limitation of Liability
    6.1. “As-Is” Basis: The Website and Courses are provided without any warranties, express or implied. We do not guarantee specific results or employment outcomes.
    6.2. Liability Cap: To the maximum extent permitted by Namibian law, the Provider’s total aggregate liability for any claim shall not exceed the total amount actually paid by the Client for the specific course in question or enrolled for.
    6.3. Indirect Losses & Exclusion of Damagers: The Provider shall not be liable for any indirect, incidental, or consequential damages, including loss of profits or data.
  7. Confidentiality and Data Protection
    7.1. Confidential Information: Both parties agree to keep all proprietary information, trade secrets, and non-public course data confidential for a period of 5 years following the termination of the agreement.
    7.2. Privacy & Data Protection: Personal data is handled in accordance with our Privacy Policy and applicable Namibian data protection principles.
  8. Termination
    8.1. Right to Terminate: The Provider reserve the right to suspend or terminate access without notice for breaches of these terms, including non-payment or IP infringement.
  9. Governing Law
    9.1. Jurisdiction: These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Namibia.
    9.2. The parties submit to the Jurisdiction of the Magistrates (Lower) Court in Namibia.
